Cette étude analyse quel est le droit applicable aux conflits en Irak de 1991 à 2004, compte tenu notamment de l’impact des résolutions pertinentes du Conseil de Sécurité. Réalisée au sein de la Direction générale Appui juridique et Médiation du Ministère de la Défense belge, l’étude ne reflète pourtant pas nécessairement la position de l’Etat belge ou du département cité. Elle est l’oeuvre de M. Frederik Naert avec l’appui de M. Jozef Vergauwen, M. Alfons Vanheusden et de Melle Isabelle Heyndrickx. Elle sera également diffusée, en français et en anglais, sur le site de la Société Internationale de Droit militaire et de Droit de la Guerre (http://www.soc-mil-law.org).

Begeleidende noot

Deze studie behandelt de vraag welk recht van toepassing is op de conflicten in Irak van 1991 tot 2004 en houdt daarbij onder andere rekening met de impact van relevante resoluties van de VNVeiligheidsraad. De studie werd gemaakt binnen de Algemene Directie Juridische Steun en Bemiddeling van het Belgisch Ministerie van Landsverdediging maar geeft niet noodzakelijk het standpunt weer van de Belgische regering of van het Belgisch Ministerie van Landsverdediging. Het onderzoek werd verricht door Dhr. Frederik Naert maar werd ook ondersteund door Dhr. Jozef Vergauwen, Dhr. Alfons Vanheusden en Juffr. Isabelle Heyndrickx. De studie zal ook gepubliceerd worden op de website van de International Society for Military Law and the Law of War (http://www.soc-mil-law.org) in het Engels en in het Frans.

In diesem Studium handelt es sich um die Frage, welches Recht anwendbar ist auf die Irakkonflikte von 1991 bis 2004 und berücksichtigt dabei unter anderem die Auswirkungen relevanter Resolutionen des Weltsicherheitsrates. Das Studium wurde innerhalb der Allgemeinen Direktion Rechtsunterstützung und Vermittlung des belgischen Verteidigungsministeriums betrieben, aber gibt jedoch nicht unbedingt den Standpunkt der belgischen Regierung oder des belgischen Verteidigungsministeriums wieder. Diese Untersuchung wurde von dem Herrn Frederik Naert geführt, aber wurde darüber hinaus auch von dem Herrn Jozef Vergauwen, dem Herrn Alfons Vanheusden und Frau Isabelle Heyndrickx unterstützt. Das Studium wird ebenfalls auf der Website der International Society for Military Law of War (http://www.soc-mil-law.org) ins Englische und ins Französische publiziert werden.

This study addresses the question what law is applicable to the conflicts in Iraq from 1991 to 2004, inter alia taking into account the impact of relevant UN Security Council resolutions. It was made within the Directorate General Legal Support and Mediation of the Belgian Ministry of Defence but does not necessarily reflect the view of the Belgian Government or the Belgian Ministry of Defence. The research was conducted by Mr. Frederik Naert but has also benefited from the input provided by Mr. Jozef Vergauwen, Mr. Alfons Vanheusden and Miss Isabelle Heyndrickx. The study will also be published on the website of the International Society for Military Law and the Law of War (http:// www.soc-mil-law.org) in English and French.

El presente estudio analiza cual es el derecho aplicable a los conflictos en Irak de 1991 a 2004, teniendo en cuenta entre otras cosas, el impacto de las resoluciones más significativas del Consejo de Seguridad. Este trabajo ha sido realizado en la Dirección general Apoyo jurídico y Mediación del Ministerio de Defensa belga, pero sin reflejar necesariamente la posición del Estado belga ni tampoco la de dicho Ministerio.
